These Terms of Service ("Terms") govern your access to and use of the SHA7N mobile application (the "App") and the related customer services provided by SHA7N ("SHA7N", "we", "us", or "our") (together, the "Service").
By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
SHA7N operates a technology platform that connects customers ("Customers", "you") with drivers and delivery partners who provide delivery and transport services. The App enables you to request deliveries, set pickup and drop-off locations, receive a price, pay, track your order, and rate your experience.
SHA7N provides the technology platform that facilitates these connections. SHA7N is not a transport or delivery company in the sense of performing the deliveries itself; the deliveries are performed by independent drivers.
2. Eligibility
To use the Service, you must:
- Be of legal age to enter into a binding contract in Iraq.
- Provide accurate registration and contact information.
- Use the Service only for lawful purposes and for goods you are permitted to send.
- Comply with all applicable laws.
We may refuse, suspend, or revoke access if you do not meet these requirements.
3. Account Registration and Verification
- You register using your phone number, which is verified by a one-time SMS code.
- You may optionally add and verify an email address, or sign in using a supported third-party account (Google, Apple, Facebook, or FIB).
- You must provide accurate, complete, and up-to-date information.
- You are responsible for all activity that occurs under your account and for keeping your login credentials secure.
- You may register and use only one Customer account unless we expressly permit otherwise.
You authorize SHA7N to verify your information for eligibility, safety, and fraud-prevention purposes.
4. Using the Service and Customer Conduct
When using the Service, you agree to:
- Provide accurate pickup and drop-off locations, delivery contact details, and instructions.
- Request the delivery only of lawful goods you are entitled to send, and never illegal, dangerous, or prohibited items.
- Be reachable and available, or ensure your recipient is, so the driver can complete the delivery.
- Treat drivers and SHA7N staff with respect and without discrimination, harassment, or abuse.
- Pay for the orders you request in accordance with these Terms.
You are responsible for the accuracy of the order details you provide and for any loss or additional cost arising from incorrect details.
5. Orders, Pricing, and Payment
- Each order shows its price before you confirm it. Prices may reflect distance, items, applicable fees, discounts, and reward points.
- You can pay using the methods available in the App, which may include your in-app wallet balance, online payment through our payment partner (FIB), or pay-later where offered.
- You may add funds to your wallet and earn or redeem reward points where available. Wallet balances, deposits, payments, and adjustments are recorded as transactions you can view in the App.
- Charges, fees, and any applicable taxes are presented in the App. We may update pricing and fees, and the applicable rates are made available to you in the App or through other communications.
- Refunds and adjustments, where due, are credited according to our policies and applicable law. We may withhold, adjust, or reverse amounts associated with fraud, error, chargebacks, disputes, or violations of these Terms.
6. Location
The Service uses your device location, while the App is in use, to let you set pickup and drop-off points and to track your active order. By using these features you consent to this collection as described in the Privacy Policy. The customer App does not track your location in the background. If you disable location access, some features may not work, but you can still enter addresses manually.
7. Ratings and Feedback
After an order, you may rate and provide feedback on the driver and the delivery. You agree to provide ratings and feedback that are honest and not abusive, defamatory, or misleading. We may use this feedback to maintain service quality and platform safety.
8. Prohibited Conduct
You must not:
- Provide false, misleading, or fraudulent information.
- Request the transport of illegal, dangerous, or prohibited goods.
- Manipulate pricing, payments, ratings, rewards, or incentive systems.
- Interfere with, reverse engineer, disrupt, or attempt to gain unauthorized access to the Service or its systems.
- Use another person's account or allow another person to use yours.
- Harass, threaten, or endanger drivers, other users, or SHA7N staff.
9. Intellectual Property
The App, the SHA7N name and logos, and all related software and content are owned by SHA7N or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely to request and manage Services as a Customer. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service.
10. Suspension and Termination
- You may stop using the Service and request account deletion at any time (see the Privacy Policy, Section 11).
- We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, provide false information, pose a safety or fraud risk, or where required by law.
- Upon termination, your right to use the App ends. Outstanding balances and obligations to SHA7N remain due, and any refunds owed to you will be settled subject to verification and these Terms. Provisions that by their nature should survive termination (including payment, liability, and governing law) will survive.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, SHA7N disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or always available, or that a driver will always be available for a given order.
Deliveries are performed by independent drivers. SHA7N is not responsible for the conduct of drivers, customers, or third parties, or for events occurring during deliveries that are outside our reasonable control.
12. Limitation of Liability
To the fullest extent permitted by law, SHA7N and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. To the extent SHA7N is found liable, our total aggregate liability will not exceed the total amounts you paid to SHA7N for the order giving rise to the claim, or the fees paid to SHA7N in the three (3) months preceding the event, whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless SHA7N and its officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, the orders you request, your breach of these Terms, or your violation of any law or the rights of any third party.
14. Changes to the Service and Terms
We may modify the Service or these Terms at any time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you in the App. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Iraq, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Iraq, unless otherwise required by applicable law.
